1.3 Your use of the eSIM Service will be governed by these Terms and Conditions of Use.

1.4 References in these Terms to the Site includes https://skylimit.app and all associated web pages.

1.5 You should read these Terms carefully before using the Site or purchasing any eSIM products.

1.6 By accessing or using the Site or otherwise indicating your consent, you agree to be bound by these Terms and the documents referred to in them.

1.7 If you do not agree with or accept any of these Terms, you should stop using the Site immediately.

2.1 You agree that you are solely responsible for:

• All costs and expenses you may incur in relation to your use of the Site; and
• Keeping your password and other account details (if any) confidential.

2.2 If you choose to access the Site from locations outside the United States, you are responsible for compliance with local laws where they are applicable.

2.4 We may prevent or suspend your access to the Site, the eSIM Service, or the Apps if you do not comply with any part of these Terms, any terms or policies to which they refer, or any applicable law.

3. eSIM Service Description

3.1 SkyLimit provides digital eSIM products that enable mobile data connectivity in 200+ countries and regions worldwide.

3.2 Our eSIMs are delivered electronically via QR code and can be installed on compatible devices.

• eSIM products are digital goods delivered instantly after purchase
• Data plans have specified validity periods and data allowances
• Coverage and speeds vary by location and network availability
• Service is data-only; voice calls and SMS are not included unless specified

4. Eligibility and Device Requirements

4.1 To use our eSIM products, you must:

• Be at least 18 years of age or have parental/guardian consent
• Have an eSIM-compatible device (see our compatibility page)
• Have a carrier-unlocked device
• Have a stable internet connection (WiFi or mobile data) for eSIM installation

4.2 You acknowledge that it is your responsibility to verify device compatibility before making a purchase. SkyLimit is not responsible for purchases made for incompatible devices.

5. Your Privacy and Personal Information

5.1 Your privacy and personal information are important to us. Any personal information that you provide to us – whether via the Site, the eSIM Service, or the Apps – will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information, and how to contact us and supervisory authorities in the event you have a query or complaint about the use of your personal information.

6. Purchase and Payment

6.1 All prices are displayed in USD unless otherwise specified. Payment is required at the time of purchase.

6.2 We accept major credit cards, debit cards, and cryptocurrency through our secure payment partners.

6.3 By making a purchase, you represent that:

• You have the legal right to use the payment method provided
• The information you provide is accurate and complete
• You are authorized to make the purchase

6.4 Upon successful payment, your eSIM QR code and installation instructions will be delivered to your registered email address and available in your account dashboard.

7. eSIM Installation and Activation

7.1 After purchase, you will receive a QR code via email for eSIM installation. You are responsible for:

• Installing the eSIM on a compatible, unlocked device
• Following the installation instructions provided
• Keeping a copy of your QR code (some devices allow only one-time scanning)
• Ensuring your device has a stable internet connection during installation

7.2 Important: Once an eSIM is installed on a device, it typically cannot be transferred to another device. Please ensure you install on your intended device.

8. Data Plan Terms

• Validity Period: Begins when you first connect to a network in the covered region, unless otherwise specified in the plan details
• Data Allowance: As specified in your plan details
• Network Speed: 4G/LTE/5G where available; actual speeds may vary by location and network conditions
• Service Type: Data-only service; does not include voice calls or SMS unless explicitly stated
• Hotspot/Tethering: Allowed unless otherwise specified in the plan details
• Unused Data: Unused data does not roll over and expires at the end of the validity period

9. Ownership, Use, and Intellectual Property Rights

9.1 The Site, the eSIM Service, and the Apps and all intellectual property rights in them including but not limited to any Content are owned by us, our licensors, or both (as applicable). Intellectual property rights refers to rights such as: copyright, trademarks, domain names, design rights, database rights, patents, and all other intellectual property rights of any kind whether they are registered or unregistered (anywhere in the world). We and our licensors reserve all our and their rights in any intellectual property in connection with these Terms.

9.2 Nothing in these Terms grants you any legal rights in the Site, the eSIM Service, or the Apps other than as necessary to enable you to access the Site, the eSIM Service, or the Apps. You agree not to adjust or try to circumvent or delete any notices contained on the Site (including any intellectual property notices) and in any digital rights or other security technology embedded or contained within the Site, the eSIM Service, or the Apps.

9.3 Trademarks: "SkyLimit" and our logo are our trademarks. Other trademarks and trade names may also be used on the Site. The use of any trademarks on the Site is strictly prohibited unless you have our prior written permission.

10. Refund Policy

10.2 As eSIMs are digital products, refund eligibility depends on whether the eSIM has been installed or data has been consumed.

11. Acceptable Use and Prohibited Uses

11.1 You agree not to:

• Resell, redistribute, or commercially exploit our eSIM products without authorization
• Use the service for any illegal or unauthorized purposes
• Attempt to circumvent data limits, validity periods, or any technical restrictions
• Share your eSIM credentials or QR codes with others for unauthorized use
• Use the service for spam, phishing, or any malicious activities
• Interfere with or disrupt the integrity or performance of the Site or eSIM Service

11.2 You must not misuse the Site, the eSIM Service, or the Apps by knowingly introducing viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful. You must not attempt to gain unauthorized access to the Site, the eSIM Service, or the Apps, the server on which the Site is stored, or any server, computer, or database connected to the Site, the eSIM Service, or the Apps.

11.3 By breaching this provision, you may commit a criminal offense. We will report any such breach to the relevant law enforcement authorities, and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site, the eSIM Service, and the Apps will cease immediately.

12. Security and Accuracy of Information

12.1 While we try to make sure that the Site, the eSIM Service, and the Apps are accurate, up-to-date, and free from bugs, we cannot promise that they will be. Furthermore, we cannot promise that the Site, the eSIM Service, or the Apps will be fit or suitable for any purpose. 12.5 We do not guarantee that the Site, the eSIM Service, or the Apps will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs, and platform to access the Site, the eSIM Service, and the Apps. You should use your own virus protection software.

14. Limitation of Liability

14.1 Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information:

14.2 Whether you are a Consumer or a Business User: We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors and for fraud or fraudulent misrepresentation.

14.3 If you are a Business User: We exclude all implied conditions, warranties, representations, or other terms that may apply to the Site, the eSIM Service, or the Apps (or any content therein). We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

• Use of (or inability to use) the Site, the eSIM Service, or the Apps; or
• Reliance on any content on the Site or contained in the eSIM Service or the Apps

And we shall not be liable for:

• Loss of profits, sales, business, or revenue
• Business interruption
• Loss of anticipated savings
• Loss of business opportunity, goodwill, or reputation
• Any indirect or consequential loss or damage

14.4 If you are a Consumer – our liability: We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

14.5 If you are a Consumer – we are responsible to you for foreseeable loss and damage caused by us: If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.

14.6 Our total liability to you shall not exceed the amount paid by you for the eSIM product in question.

15. Events Beyond Our Control

We shall have no liability to you for any breach of these Terms caused by any event or circumstance beyond our reasonable control including, but not limited to: strikes, lockouts or other industrial disputes; breakdown of systems or network access; flood, fire, explosion or accident; acts of government or regulatory authorities; pandemic or epidemic; natural disasters; war, terrorism, or civil unrest; or failure of third-party network providers.

16. Rights of Third Parties

No one other than a party to these Terms has any right to enforce any of these Terms.

17. Variation

17.1 These Terms were last updated on February 18, 2026. No changes to these Terms are valid or have any effect unless agreed by us in writing or made in accordance with this clause 17.

17.2 We reserve the right to vary these Terms from time to time. Our updated Terms will be displayed on the Site and by continuing to use and access the Site following such changes, you agree to be bound by any variation made by us. It is your responsibility to check these Terms from time to time to verify such variations.

18. Disputes

18.1 We will try to resolve any disputes with you quickly and efficiently.

18.2 If you are unhappy with us, please contact us as soon as possible at support@skylimit.app.

18.3 If you are a Consumer User: These Terms, their subject matter, and their formation, are governed by the laws of the State of Delaware, USA. You and we both agree that the courts of Delaware will have non-exclusive jurisdiction, meaning you may also bring proceedings in the courts of your country of residence if applicable consumer protection laws permit.

18.4 If you are a Business User: These Terms, their subject matter, and their formation (and any non-contractual disputes or claims) are governed by the laws of the State of Delaware, USA. We both agree to the exclusive jurisdiction of the courts of Delaware.
